【公告】关于严厉整治峨眉山景区旅游秩序的规定【Notice】Regulations on Strictly Rectifying the Tourist Order in Emei Mountain Scenic Area

第一条  为保护峨眉山文化与自然遗产，维护国家级风景名胜区和国家5A级旅游景区荣誉，严厉整治峨眉山景区旅游秩序，确保长效治理，根据《中华人民共和国治安管理处罚法》《中华人民共和国旅游法》等法律法规和政策，结合景区实际，制定本规定。

第二条  破坏峨眉山景区旅游秩序的行为包括下列情形：

（一）喊客拉客或拦车追车拉客的；

（二）从事非法运营的；

（三）欺诈、诱导旅游者消费或宰客的；

（四）经营企业（户）不明码标价、在标价之外加价或收取未标明的费用的；

（五）未取得导游证从事导游活动或导游人员私自承揽业务、诱导消费的；

（六）车辆在景区主要道路或公共场所乱停乱放的；

（七）经营企业（户）参与喊客拉客或接受违规人员引导游客到其经营场所消费的；

（八）其他破坏景区旅游秩序的行为。

第三条  喊客拉客、拦截、追撵车辆或强登、扒乘机动车喊客拉客的，由景区公安分局处警告或200元罚款；对喊客拉客三次以上的，由景区公安分局处5日以上10日以下拘留，并处500元罚款。

第四条  从事非法运营的，由峨眉山市道路运输管理所扣押非法运营车辆，并对非法经营者处3万元以上10万元以下罚款。

第五条  欺诈、诱导旅游者消费或宰客的，由峨眉山市市场监督管理局责令其返还消费金额并3倍赔偿消费者；同时，没收经营者违法所得，处违法所得1倍以上10倍以下罚款。

第六条  不明码标价、在标价之外加价或收取未标明的费用的，由峨眉山市市场监督管理局没收违法所得，并处3000元以上5000元以下罚款。

第七条  未取得导游证从事导游活动的，由景区旅游执法机构没收违法所得，并处5000元以上1万元以下罚款。

导游人员私自承揽业务、欺骗、胁迫旅游者消费的，由景区旅游执法机构没收违法所得，并处5000元以上3万元以下罚款，同时依法吊销其导游证。

第八条  车辆在景区主要道路或公共场所乱停乱放的，由景区交警大队从严处罚。

第九条  经营企业（户）参与喊客拉客或接受违规人员引导游客到其经营场所消费的，依法处罚并限制其享受景区管委会相关优惠政策。

第十条  对违反本规定第二条的经营企业（户）、个人依法处罚并作如下处理：

是经营企业（户）的，第一次查实，其负责人、涉事人员为黄湾镇村民的，取消景区专项资金，已享受景区养老补助的，取消个人景区养老补助；尚未享受景区养老补助的，到龄后不再享受。第二次查实，撤销景区经营许可证，终止其经营。

是黄湾镇村民的，第一次查实，责令其认错并取消景区专项资金。第二次查实，其已享受景区养老补助的，取消个人景区养老补助；尚未享受景区养老补助的，到龄后不再享受。第三次查实，取消其涉事家庭成员景区专项资金，已享受景区养老补助的，取消个人景区养老补助；尚未享受景区养老补助的，到龄后不再享受；涉事人员在景区从事经营项目的，撤销景区经营许可证，终止其经营。

是景区从业人员的，取消其景区从业资格，景区经营企业（户）使用此类人员的，限制其享受峨眉山市人民政府和景区管委会相关优惠政策。

第十一条  对其他符合治安处罚条件的，由公安机关从严处罚；破坏景区旅游秩序构成犯罪的，由司法机关依法追究刑事责任。

第十二条  在峨眉山市建立诚信体系，将破坏景区旅游秩序人员纳入该体系，限制此类人员在峨眉山市从事旅游服务类经营活动及享受峨眉山市人民政府相关优惠政策。

峨眉山市境内任何企、事业单位聘用此类人员的，限制其享受峨眉山市人民政府相关优惠政策。

第十三条  管委会、景区国有企业、黄湾镇人民政府及社区工作人员、黄湾镇各村组干部参与破坏景区旅游秩序的，从严处罚。涉事人员为中共党员、公职人员的，从严给予党纪政务处分；涉事人员为村、社区党组织班子成员的，按程序免除其职务；其余社区、村组干部及村（居）民小组长，依法从严处理。涉事人员为聘用、合同人员的，解除劳动关系；为社区社工人员的，予以辞退。

第十四条  从事景区旅游秩序管理的人员，不履职尽责、失职渎职、徇私枉法的，身份为中共党员、公职人员的，从严给予党纪政务处分；聘用、合同人员解除劳动关系。构成犯罪的，由司法机关依法追究刑事责任。
Article 1: In order to protect the cultural and natural heritage of Mount Emei, maintain the honor of the national-level scenic area and the national 5A-level tourist scenic area, severely rectify the tourism order in Mount Emei Scenic Area, and ensure long-term governance, this regulation is formulated in accordance with laws, regulations and policies such as the Law of the People's Republic of China on Administrative Penalties for Public Security and the Tourism Law of the People's Republic of China, and in combination with the actual situation of the scenic area. Article 2: The acts that disrupt the tourism order in Mount Emei Scenic Area include the following situations: (1) Soliciting customers or stopping vehicles and chasing vehicles to solicit customers; (2) Engaging in illegal operation; (3) Cheating, inducing tourists to consume or overcharging customers; (4) Business enterprises (households) not clearly marking prices, adding prices beyond the marked prices or charging unmarked fees; (5) Engaging in tour guiding activities without obtaining a tour guide certificate, or tour guides privately undertaking business and inducing consumption; (6) Vehicles randomly parking in the main roads or public places of the scenic area; (7) Business enterprises (households) participating in soliciting customers or accepting guidance from illegal personnel to direct tourists to consume at their business places; (8) Other acts that disrupt the tourism order of the scenic area. Article 3: For those who solicit customers, intercept or chase vehicles, or forcefully board or cling to motor vehicles to solicit customers, the Public Security Sub-bureau of the scenic area shall give a warning or impose a fine of 200 yuan; for those who solicit customers more than three times, the Public Security Sub-bureau of the scenic area shall impose a detention of not less than 5 days but not more than 10 days, and shall also impose a fine of 500 yuan. Article 4: For those engaging in illegal operation, the Emeishan Road Transport Management Institute shall seize the illegally operated vehicles, and impose a fine of not less than 30,000 yuan but not more than 100,000 yuan on the illegal operators. Article 5: For those who cheat, induce tourists to consume or overcharge customers, the Emeishan Market Supervision and Administration Bureau shall order them to return the consumption amount and compensate consumers three times the amount; at the same time, confiscate the illegal income of the operators and impose a fine of not less than 1 time but not more than 10 times the illegal income. Article 6: For those who do not clearly mark prices, add prices beyond the marked prices or charge unmarked fees, the Emeishan Market Supervision and Administration Bureau shall confiscate the illegal income and impose a fine of not less than 3,000 yuan but not more than 5,000 yuan. Article 7: For those who engage in tour guiding activities without obtaining a tour guide certificate, the tourism law enforcement agency of the scenic area shall confiscate the illegal income and impose a fine of not less than 5,000 yuan but not more than 10,000 yuan. For tour guides who privately undertake business, deceive or coerce tourists to consume, the tourism law enforcement agency of the scenic area shall confiscate the illegal income and impose a fine of not less than 5,000 yuan but not more than 30,000 yuan, and at the same time revoke their tour guide certificates in accordance with the law. Article 8: For vehicles randomly parking in the main roads or public places of the scenic area, the Traffic Police Brigade of the scenic area shall impose strict penalties. Article 9: For business enterprises (households) that participate in soliciting customers or accept guidance from illegal personnel to direct tourists to consume at their business places, they shall be punished in accordance with the law and be restricted from enjoying the relevant preferential policies of the Scenic Area Management Committee. Article 10: For business enterprises (households) and individuals that violate Article 2 of this regulation, they shall be punished in accordance with the law and be dealt with as follows: For business enterprises (households), if it is verified for the first time and the person in charge and the involved personnel are villagers of Huangwan Town, the special funds of the scenic area shall be cancelled. If they have already enjoyed the old-age subsidy of the scenic area, the individual old-age subsidy of the scenic area shall be cancelled; if they have not yet enjoyed the old-age subsidy of the scenic area, they shall no longer enjoy it upon reaching the eligible age. If it is verified for the second time, the business license of the scenic area shall be revoked and their business shall be terminated. For villagers of Huangwan Town, if it is verified for the first time, they shall be ordered to admit their mistakes and the special funds of the scenic area shall be cancelled. If it is verified for the second time, if they have already enjoyed the old-age subsidy of the scenic area, the individual old-age subsidy of the scenic area shall be cancelled; if they have not yet enjoyed the old-age subsidy of the scenic area, they shall no longer enjoy it upon reaching the eligible age. If it is verified for the third time, the special funds of the scenic area for the family members involved in the incident shall be cancelled. If they have already enjoyed the old-age subsidy of the scenic area, the individual old-age subsidy of the scenic area shall be cancelled; if they have not yet enjoyed the old-age subsidy of the scenic area, they shall no longer enjoy it upon reaching the eligible age. If the involved personnel are engaged in business projects in the scenic area, the business license of the scenic area shall be revoked and their business shall be terminated. For employees in the scenic area, their qualifications to work in the scenic area shall be cancelled. If business enterprises (households) in the scenic area employ such personnel, they shall be restricted from enjoying the relevant preferential policies of the Emeishan Municipal People's Government and the Scenic Area Management Committee. Article 11: For those who meet the conditions for public security penalties, the public security organs shall impose strict penalties; for those whose acts of disrupting the tourism order of the scenic area constitute a crime, the judicial organs shall investigate their criminal responsibilities in accordance with the law. Article 12: A credit system shall be established in Emeishan City, and those who disrupt the tourism order of the scenic area shall be included in this system, and such personnel shall be restricted from engaging in tourism service business activities in Emeishan City and enjoying the relevant preferential policies of the Emeishan Municipal People's Government. If any enterprise or public institution within the jurisdiction of Emeishan City employs such personnel, it shall be restricted from enjoying the relevant preferential policies of the Emeishan Municipal People's Government. Article 13: For the staff of the Management Committee, state-owned enterprises in the scenic area, the People's Government of Huangwan Town, community staff, and cadres of each village group in Huangwan Town who participate in disrupting the tourism order of the scenic area, strict penalties shall be imposed. If the involved personnel are Communist Party members or public officials, they shall be given strict disciplinary and administrative sanctions in accordance with the Party discipline; if the involved personnel are members of the village or community Party organization leadership team, their positions shall be removed in accordance with the procedures; the remaining community and village group cadres and village (residential) group leaders shall be dealt with strictly in accordance with the law. If the involved personnel are employed or contract workers, the labor relationship shall be terminated; if they are community social workers, they shall be dismissed. Article 14: For the personnel engaged in the management of the tourism order in the scenic area who do not perform their duties conscientiously, are derelict of duty, or bend the law for personal gain, if they are Communist Party members or public officials, they shall be given strict disciplinary and administrative sanctions in accordance with the Party discipline; if they are employed or contract workers, the labor relationship shall be terminated. If a crime is constituted, the judicial organs shall investigate their criminal responsibilities in accordance with the law.
